A South Florida high school assistant principal is trying to get a criminal charge against him thrown out of court.

An attorney for Daniel Snider told a judge that the man didn't have the responsibility of reporting to the Department of Children and Families claims that his teenage son attempted to sexually assault a 15-year old girl.

“This is not a situation where Mr. Snider’s alleged to have acted to conceal any message given to him. He passed it along as he was told to do, which is consistent with school board policy, which is consistent with what his superior officer at the school board - a government agency - told him to do.”

Leonard Feuer claims his client had the right to protect his son under Florida's right to privacy law. But Prosecutor Joseph Kadis says state law is clear.

"I believe that the language promotes contacting DCF and getting them involved as soon as possible.”

Snider and other staffers at Palm Beach Central High face charges for not reporting the suspected abuse to authorities. They include the school's principal and a chorus teacher.

The boy was never charged with a crime.

The judge has not yet ruled on whether to drop the charges against Snider, claiming he is considering the requests from both sides just offered to him on Monday.
