A Jupiter man is attempting to get out of jail while awaiting sentencing for locking his adopted son in a box that was built in the garage of their home.

At Thursday's bond hearing for Tim Ferriter, defense attorney Khurrum Wahid told the judge that there is "no doubt" his client will show up to be sentenced next month.

"In terms of travel and that sort of thing, there's no intention to leave the state of Florida, in fact not even leave the County of Palm Beach."

He pointed out that Ferriter was on bond prior to his trial, but prosecutor Brianna Coakley says this time around the man is facing up to 40-years in prison.

"That creates a substantial risk of a flight risk your honor that was not present before."

She also called a pre-sentence release "incredibly rare," and the judge agreed.

He says he will issue a written ruling "as quickly as possible." Ferriter's sentencing hearing is set for November 16.

His wife, Tracy Ferriter, still faces her own trial on the same charges of child abuse, child neglect and false imprisonment.
